TERMS & CONDITIONS OF THE PRASKA.shop ONLINE STORE (UK customers)

Effective date: 1 September 2026

1. Who we are

  1. The PRASKA.shop online store at praska.shop (the "Store") is operated by:

  1. These Terms & Conditions ("Terms") set out how the Store works, how orders are placed, how contracts of sale are formed and performed, your right to cancel, and how we deal with faulty goods and complaints. They are written for customers ordering from the United Kingdom.
  2. We are the controller of personal data processed in connection with these Terms. Details are set out in the Privacy Policy published in the Store.
  3. Nothing in these Terms limits or excludes any rights you have as a consumer under law that cannot be limited or excluded by agreement, in particular under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If any provision of these Terms is less favourable to you than those rules, the statutory rules apply instead, and any doubt is resolved in your favour.

2. Definitions

  1. Seller / we / us: Eco Cats Collection Sp. z o.o. as identified in section 1.
  2. Store: the online store operated by the Seller at praska.shop.
  3. Customer / you: anyone purchasing through the Store or using its services.
  4. Consumer: an individual acting for purposes that are wholly or mainly outside that individual's trade, business, craft or profession.
  5. Business Customer: a Customer who is not a Consumer.
  6. Product (Goods): a movable item available in the Store and forming the subject of a Sales Contract.
  7. Bespoke Product: a non-prefabricated Product made to your individual specification going beyond the standard configuration options offered in the Store, in particular a Product with dimensions agreed individually with you, or made from material supplied or sourced at your request from outside the Store's range. A Product whose features you have chosen solely from the standard options offered in the Store (for example a colour or fabric picked from the list of variants) is not a Bespoke Product.
  8. Sales Contract: a contract for the sale of a Product concluded between you and the Seller through the Store.
  9. Distance contract: a contract concluded through the Store without the parties being physically present together, using only means of distance communication.
  10. Order: your statement made using the order form, aimed directly at concluding a Sales Contract.
  11. Account: your account in the Store, storing the details you provide and information about your Orders.
  12. Basket: the Store feature showing the Products you have selected, where you can adjust the Order, in particular quantities.

4. Technical requirements and general information

  1. To use the Store, including browsing Products and placing Orders, you need: a device with internet access and an up-to-date web browser supporting JavaScript and cookies, an active e-mail account, and, for some payment methods, access to the relevant payment service.
  2. We take steps to keep the Store working correctly. We are not responsible for interruptions caused by force majeure or unlawful acts of third parties; this does not limit any liability to Consumers that cannot be excluded by law.
  3. You can browse the Store without an Account. Orders can be placed with an Account or as a guest by providing the details needed to fulfil the Order.
  4. Prices shown in the Store include applicable taxes as displayed and are expressed in Polish złoty (PLN), unless you have selected another currency made available in the Store; the currency can be selected independently of the language version, and the binding price for your Order is the price shown at checkout at the time you place it.
  5. The final amount payable consists of the price of the Product plus delivery costs (including transport, delivery and postal charges), which are shown to you in the Store during checkout, including at the moment you confirm you wish to be bound by the Sales Contract.
  6. Where the nature of the Product means the final price cannot reasonably be calculated in advance, the Store's Product description (or an e-mail from us) explains how the price will be calculated, together with transport and other costs.
  7. Import duties and taxes. The United Kingdom is outside the European Union. Orders delivered to the UK may be subject to UK import VAT, customs duty and carrier handling fees charged on import. Unless expressly stated otherwise during checkout, these charges are payable by the recipient and are not included in our prices; we tell you about the possibility of such charges before you place an Order.

5. Your Account

  1. An Account is created by completing the registration form. Creating an Account is free and voluntary.
  2. You log in using the login and password set in the registration form.
  3. You may delete your Account at any time, without giving a reason and free of charge, by sending a request to us, in particular by e-mail to office@praska.shop or in writing to the address in section 3.
  4. How we process personal data connected with the Account, including retention periods, is set out in the Privacy Policy.

6. Placing an Order

To place an Order:

  1. log in to the Store (optional);
  2. select the Product you wish to order (including, where applicable, a variant from the available options) and click "Add to basket";
  3. log in or use the guest checkout;
  4. complete the order form: enter the recipient's details and delivery address, choose the delivery method, and enter invoicing details if different from the recipient's details;
  5. click the "Order and pay" button;
  6. choose one of the available payment methods and, depending on the method, pay for the Order within the stated time.

7. Delivery

  1. The delivery methods, carriers and delivery costs available for your Order and delivery country are always shown to you at checkout (in the Basket) before you place the Order. Delivery costs are borne by you unless stated otherwise at checkout. A change to the list of available delivery methods or carriers does not amend these Terms.
  2. We deliver worldwide, including to the United Kingdom. Delivery costs are shown in the Store during checkout.
  3. Delivery is charged for unless the Sales Contract states otherwise.
  4. Import duties, taxes and related charges for deliveries to the UK are dealt with in section 4.7.
  5. Order handling time (preparing the Order for dispatch) is up to 10 working days. In promotional periods this may extend to up to 14 working days, of which you are informed before placing the Order. Delivery time to the UK is additional and depends on the carrier.
  6. Express handling, up to 78 hours, is available only where every Product in the Basket is covered by that option.
  7. The handling time starts: for payment by bank transfer, online payment or card, on the day our bank account is credited; for cash on delivery (where available), on the day the Sales Contract is concluded.

8. Payment

  1. For orders delivered outside Poland (including the UK), the following payment methods are offered:
    • a. payment card (credit or debit card), Apple Pay or Google Pay, processed by Stripe Payments Europe, Limited;
    • b. payment via PayPal (PayPal (Europe) S.à r.l. et Cie, S.C.A.);
    • c. traditional bank transfer to the Seller's bank account (account details are given on the Contact page).
  2. The payment methods actually available for your Order and delivery country are shown at checkout (on the payment page). A change to the list of available payment methods does not amend these Terms.
  3. If you choose payment by traditional bank transfer, payment is due within 3 calendar days of the conclusion of the Sales Contract; otherwise the Order will be cancelled, of which you will be informed.
  4. We do not charge you any additional fee for using a particular payment method.

9. Formation and performance of the Sales Contract

  1. A Sales Contract is concluded after you place an Order using the order form in accordance with these Terms.
  2. After you place an Order, we promptly confirm receipt and accept the Order for processing by sending an e-mail to the address you gave when ordering, containing at least our statement that the Order has been received and accepted for processing and confirmation of the conclusion of the Sales Contract. The Sales Contract is concluded when you receive that e-mail.
  3. Our Products are handmade to order; handling times are set out in sections 7.5–7.6.
  4. Where a Product description allows an individual specification to be agreed (a Bespoke Product within the meaning of section 2.7), we confirm the terms of that order to you before you place it, including the fact that the right to cancel does not apply (section 10.10).

10. Right to cancel (Consumer Contracts Regulations 2013)

  1. If you are a Consumer and have concluded a distance Sales Contract, you may cancel it within 14 days without giving any reason and without cost, except the costs referred to in sections 10.8 and 10.9. This right arises under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
  2. The cancellation period ends 14 days after the day on which you (or a person you nominate, other than the carrier) take physical possession of the Product. Where a single Order covers several Products delivered separately, in lots or in pieces, the period ends 14 days after the day you take possession of the last Product, lot or piece.
  3. To meet the deadline it is enough to send your cancellation notice before the period expires. You cancel by making a clear statement to us, by e-mail to office@praska.shop or in writing to: Eco Cats Collection Sp. z o.o. ul. Ignacego Łukasiewicza 5, 43-502 Czechowice-Dziedzice, Poland. Your cancellation takes effect when you send it and does not require our consent or acceptance.
  4. You may use the returns form available on our "Returns & Complaints" page or the model cancellation form set out below (Schedule 3 to the 2013 Regulations), but you do not have to. Giving a reason is entirely voluntary and has no effect on the validity of your cancellation.

  1. If you cancel, the contract is treated as if it had not been made, and both parties are released from their obligations under it.
  2. We will refund all payments received from you, including the cost of delivery to you (except any additional cost arising because you chose a delivery method other than the least expensive standard method we offer).
  3. We will make the refund without undue delay and in any event no later than: (a) 14 days after the day we receive the Product back from you, or (b) if earlier, 14 days after the day you supply evidence of having sent the Product back, or (c) if we have offered to collect the Product, 14 days after the day you inform us of your cancellation. We may withhold the refund until we have received the Product back or you have supplied evidence of having sent it back, whichever is earlier.
  4. The refund is made using the same means of payment you used, unless you have expressly agreed otherwise; in any event you will not incur any fees as a result of the refund. You must send the Product back to us without undue delay and in any event no later than 14 days from the day you told us you were cancelling, to: Eco Cats Collection Sp. z o.o. ul. Ignacego Łukasiewicza 5, 43-502 Czechowice-Dziedzice, Poland. The deadline is met if you send the Product before the 14 days expire. You bear the direct cost of returning the Product.
  5. You are liable only for any diminished value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics and functioning; we may deduct that amount from the refund, but it does not otherwise delay or condition the refund described in sections 10.6–10.8.
  6. The right to cancel does not apply to a contract for the supply of goods that are made to the consumer's specifications or are clearly personalised (regulation 28(1)(b) of the 2013 Regulations). In our Store this covers only Bespoke Products within the meaning of section 2.7, Products made to individual arrangements going beyond the Store's standard options (for example dimensions agreed individually with you). We will tell you that a Product is a Bespoke Product and cannot be returned at the latest before you place the Order. Choosing a Product variant (such as a colour or fabric) from the standard options offered in the Store does not deprive you of the right to cancel.

11. Faulty goods, your rights under the Consumer Rights Act 2015

  1. If you are a Consumer, every Product we sell must be of satisfactory quality, fit for purpose and as described (Consumer Rights Act 2015). We are liable to you if the Product does not conform to the contract. Your statutory remedies are as follows.
  2. Within 30 days of delivery: if the Product is faulty, you may exercise the short-term right to reject it and receive a full refund.
  3. After 30 days (or instead of rejecting): you may require us to repair or replace the Product. We will do so within a reasonable time and without significant inconvenience to you, and we bear all costs of the repair or replacement, including postage, carriage, labour and materials. We collect the Product for repair or replacement at our cost and bear the cost of delivering the repaired or replacement Product back to you. We may provide a replacement where you ask for a repair (or a repair where you ask for a replacement) only if your chosen remedy is impossible or disproportionate compared with the other.
  4. If a repair or replacement fails, the fault remains or recurs, or the remedy is impossible, or we cannot provide it within a reasonable time and without significant inconvenience, you may claim a price reduction or exercise the final right to reject the Product and receive a refund. Where the final right to reject is exercised more than six months after delivery, the refund may be reduced to reflect use you have had of the Product, as the 2015 Act allows; no such deduction is made within the first six months.
  5. Burden of proof: a fault appearing within 6 months of delivery is presumed to have been present at delivery, unless we prove otherwise or the presumption is incompatible with the nature of the Product or fault. (This presumption does not apply to the 30-day short-term right to reject, where the ordinary rules of proof apply.) After 6 months it is for you to show the fault was present at delivery. Claims for faulty goods are not limited to any fixed "guarantee period": they can generally be brought within the statutory limitation period, up to 6 years in England, Wales and Northern Ireland, and 5 years in Scotland.
  6. How to complain: you can complain in any form, preferably by e-mail to office@praska.shop, or in writing to: Eco Cats Collection Sp. z o.o. ul. Ignacego Łukasiewicza 5, 43-502 Czechowice-Dziedzice, Poland. To help us deal with the complaint quickly (this is not a condition of considering it), please give your contact details, identify the Product and the date of purchase, describe the fault and state your chosen remedy.
  7. Purchase may be evidenced by any proof of purchase: for example a receipt, invoice, bank transfer or payment confirmation, bank statement, or the order confirmation e-mail. We never make dealing with a complaint conditional on producing a till receipt.
  8. Response time: we respond to complaints within 14 days of receipt. This is our service standard; it does not affect your statutory rights, and your remedies do not depend on our response. Refunds due under this section are paid without undue delay, and in any event within 14 days of our agreeing that you are entitled to one, using the same means of payment you used unless you expressly agree otherwise.
  9. Do not send a faulty Product back at your own cost before agreeing the collection or return arrangements with us, collection and return for repair, replacement or rejection are at our cost.
  10. For Business Customers, the terms implied by sections 13–15 of the Sale of Goods Act 1979 are excluded to the fullest extent permitted by law, and our total liability in connection with a Sales Contract is limited to the price paid, save that nothing excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.

12. Outlet Products

  1. Products offered in the Outlet section may have specific, described deviations from the usual conformity requirements (for example a stated instance of damage, discolouration or display wear). We are not liable for a lack of conformity only as regards that specific characteristic expressly identified in the Product description, which was specifically drawn to your attention before the contract was made (section 9(4) of the Consumer Rights Act 2015).
  2. In all other respects Outlet Products carry the full rights described in section 11, in particular as regards any fault other than the one identified in the description.

13. Complaints handling and dispute resolution

  1. If you are unhappy with anything, please contact us first, by e-mail to office@praska.shop or in writing to the address in section 3. We aim to resolve every complaint directly and respond within 14 days.
  2. There is no alternative dispute resolution (ADR) scheme that we are required by law to use for this sector in the UK, and we are not currently signed up to any ADR scheme. If we cannot resolve a dispute with you directly, we will tell you in our final response whether we are willing, in that case, to use a certified ADR provider.
  3. Nothing in these Terms affects your right to bring a claim before the courts; as a UK consumer you may be able to bring proceedings in the UK courts (see section 15.1).

14. Personal data

  1. The controller of Customers' personal data collected through the Store is the Seller.
  2. Details of how we process personal data, purposes, legal bases, recipients, retention periods and your rights, are set out in the Privacy Policy available in the Store.
  3. Providing personal data is voluntary, but without the data needed to conclude a Sales Contract the contract cannot be concluded.

15. Changes to these Terms

  1. We may change these Terms for valid reasons, in particular changes in the law, changes to payment or delivery methods, or changes to the scope or manner of the electronic services we provide, to the extent those reasons affect the Terms.
  2. Sales Contracts concluded before a change takes effect are governed by the Terms in force when the Order was placed. Changes do not affect rights you have already acquired.
  3. For services provided on an ongoing basis (such as the Account), we will notify Account holders of changes by e-mail at least 14 days before they take effect. If you do not accept a change, you may close your Account free of charge at any time before the change takes effect.

16. General provisions

  1. Sales Contracts concluded through the Store are governed by Polish law. If you are a Consumer habitually resident in the United Kingdom, this choice of law does not deprive you of the protection of the mandatory consumer laws of the United Kingdom (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013), and does not affect any right you may have to bring or defend proceedings in the UK courts.
  2. Contracts through the Store may be concluded in Polish, English, French or German, depending on the language version of the Store you use. In the event of any discrepancy between language versions of these Terms, the Polish version prevails.
  3. Nothing in these Terms limits your ability to pursue claims before the courts; jurisdiction is determined by the generally applicable rules.
  4. Matters not covered by these Terms are governed by the applicable provisions of law, including, for UK Consumers, the mandatory provisions of UK consumer law referred to above.
